This agreement is between you and Fredson Paixao BJJ LLC, doing business as Fredson Paixao Academy (the "Academy"), 1481 W Warm Springs Rd Ste 145, Henderson, NV 89014.
1. What this agreement covers
I am at least 18 years old and am signing for myself. This agreement covers my participation in age- and level-appropriate group Brazilian jiu-jitsu classes and open mat at the Academy's training facility at the address above while I am on the membership, 10-Day Flex Pass, or drop-in in the enrollment in which I sign.
Activities may include warm-ups and conditioning, technique instruction, partner drills, takedowns, throws, ground grappling, positional training, joint locks, chokeholds, and live sparring, but only as the instructor permits for my class and experience level.
This agreement does not cover other activities, travel, or off-site events. It does not itself enroll me, authorize any payment, or change the membership agreement or the pass terms.
2. Risks I understand
Brazilian jiu-jitsu is a contact sport. Participants use physical pressure, holds, throws, and submission techniques. Training can involve falls, collisions, awkward landings, sudden movements, and contact with other people, mats, and training equipment. A partner may react unexpectedly, apply too much force, or fail to recognize a stop signal promptly. Differences in size, strength, skill, and judgment can increase the risks.
Possible injuries include bruises, cuts, mat burns, sprains, strains, torn ligaments or tendons, dislocations, broken bones, dental injuries, concussion, and injuries to the head, neck, back, or nerves. Pressure on the neck during chokeholds can cause loss of consciousness and serious injury. Contact, shared surfaces, and close proximity can expose me to skin infections and other communicable illnesses. Exertion can cause exhaustion, dehydration, or other medical emergencies. Some injuries can lead to permanent disability, paralysis, or death.
Instruction, rules, equipment, and my own care can reduce these risks but cannot eliminate them. Injury can happen during a beginner class or a controlled drill as well as during sparring.
3. My choice to participate
I have had time to read this agreement, consider these risks, and ask questions before participating. I understand the activities and risks described above and voluntarily choose to take part. Subject to the limits in Section 6, I accept these risks, including the risk of injury caused by ordinary negligence as described in Section 6.
I may decline a technique or stop participating at any time. If I do not understand a technique or feel unable to participate safely, I will ask for help or sit out. This agreement is not medical advice or medical clearance. If I am unsure whether participation is appropriate for me, I will get appropriate advice before participating.
4. Safety commitments
- Follow the instructor's directions and the rules for my class and experience level.
- Tap or clearly say stop early, before a technique becomes painful or unsafe, and immediately release a hold when a partner taps, says stop, or appears unable to respond.
- Use controlled movements, and never apply a submission suddenly or continue after a stop signal.
- Practice only the techniques permitted for the session, and spar only as the instructor directs.
- Tell the instructor promptly about an unsafe condition, injury, dizziness, unusual symptoms, or difficulty understanding a technique, and stop when continuing may be unsafe.
- Follow the Academy's hygiene and equipment rules, remove jewelry that could injure someone, and never train while impaired by alcohol or other substances.
- Follow the Academy's illness and return-to-training rules, and privately discuss any training limits or accommodations I need with staff before participating.
These commitments do not remove the Academy's legal responsibilities.
5. Emergency assistance
If I need urgent help, I ask Academy staff to contact emergency services. The Academy may privately ask me for an emergency contact. This agreement does not authorize non-emergency medical treatment or waive my rights concerning medical consent.
6. RELEASE OF CLAIMS FOR ORDINARY NEGLIGENCE
READ THIS SECTION CAREFULLY. IT LIMITS MY RIGHT TO SEEK COMPENSATION FOR CERTAIN INJURIES.
To the extent Nevada law allows, I release the Academy and its owners, instructors, and employees, only while they are acting for the Academy in connection with the covered activities, from claims that I personally have the legal authority to release for my own injury, illness, disability, death, or property damage. This applies to claims arising from my participation in the covered activities while I am on the membership, pass, or drop-in described in Section 1 and caused by their ordinary negligence.
Ordinary negligence means a failure to use reasonable care. This release specifically includes ordinary negligence in instruction, supervision, choosing training partners, and inspecting or maintaining the mats and training equipment used in the covered activities. I understand that it includes claims based on the ordinary negligence of the Academy or its personnel, within these limits.
THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT, OR ANY CLAIM, DUTY, OR RIGHT THAT THE LAW DOES NOT ALLOW TO BE RELEASED. IT DOES NOT RELEASE CLAIMS ARISING BEFORE I SIGN OR CLAIMS OF ANOTHER PERSON THAT I DO NOT HAVE LEGAL AUTHORITY TO RELEASE.
Nothing in this agreement waives a consumer-protection, membership-cancellation, or refund right that cannot legally be waived. This agreement has no arbitration clause and does not require me to reimburse or defend the Academy against anyone else's claims.
7. Signing
By signing, I confirm that I read this entire agreement, including the release in Section 6; that I understand it affects my legal rights; that I had the opportunity to ask questions; and that I sign voluntarily, for myself only. I will receive a copy of the completed record.
